🕊️ Legal Advocacy for Survivors: Reclaiming Due Process

In today’s legal system, Miranda rights protect the accused — but survivors of trauma, abuse, or stalking often receive no equivalent legal safeguards.

Instead, survivors are expected to:

  • report crimes without legal guidance,

  • recount traumatic events in hostile settings,

  • and serve as witness, evidence, and self-advocate — all while trying to recover.

This is not due process.
It’s legal abandonment at the most vulnerable moment of a person’s life.

✦ A Survivor-Centered Reinterpretation of Miranda

“You have the right to be believed.
You have the right to legal protection before speaking.
You have the right to trauma-informed representation.
Anything you say under duress should not be held against you.”

This is not a radical idea.
It is the bare minimum standard for survivor justice.

✦ New Roles, New Rights

We are advocating for the creation of a dedicated legal role — a trauma-informed attorney whose job is to represent the survivor’s body and mind as evidence, not just their words.

This attorney would:

  • Protect the physiological truth of trauma (freezing, compliance, disassociation)

  • Translate that truth into legal understanding

  • Prevent institutions from misinterpreting trauma responses as consent

This is the future of due process.

Since Miranda v. Arizona (1966), survivors have been left without mirrored protections.

We estimate the financial and emotional toll to be in the billions:
Lost wages.
Broken careers.
Retraumatization.
Legal delays.
Institutional betrayal.

We are building a national cost ticker to show what this legal gap has stolen from survivors — not just emotionally, but economically.
